Terms

These cover the use of this website and set out the principles we work by. A specific project is governed by the written proposal and agreement for that project.

01Who these terms are with

This site is operated by Ventura Flow, based in Perth, Western Australia, Australia. By using it you accept these terms. If you do not, please do not use the site.

02What is on this site

The content here is provided for information. We work to keep it accurate, but we make no guarantee that everything is complete or current at any given moment.

Nothing on this site is an offer or a quote. Descriptions of what we build are descriptions, not commitments. A commitment is made in a written proposal for a specific project.

03Timeframes and outcomes

We deliberately publish no delivery timelines. How long a project takes depends on its scope and on how quickly content and decisions come back to us, and a number here would be a promise we are not in a position to make. We also make no guarantee of any particular commercial result, search ranking, or number of hours saved. Where this site gives figures for time spent on administrative work, they are illustrative examples, not measured claims about your business.

04Ownership of work we deliver

On full payment for a project, you own what we built for you: the site, the code, the brand assets, and the automation processes we designed for you, along with the domain and hosting accounts, which are registered in your name.

This excludes third-party components, open-source software and licensed fonts, which stay under their own licences, and our own general know-how and internal tooling, which remains ours.

Ownership and operation are two different things, and they work differently for a website than for an automation. The next two sections say how.

05Websites: yours to run or hand to us

We do not charge a recurring fee to keep a website you own online. Once it is paid for and live, you can run it yourself, move it to another provider, or ask us to keep looking after it. Most clients choose ongoing management, so day to day we are the ones maintaining it, but that is an option rather than a condition.

Ask for a handover at any point and you get it. Nothing about a website we build for you depends on us still being involved.

06Automations: you own them, we operate them

The process is yours and so are the rights to it. You can have an automation paused, changed, or switched off whenever you ask, and you never need our agreement to stop.

What is not optional is who operates it. We run the platform your automations sit on and we make the changes ourselves. That is not a hold over you. A live automation reaching into your inbox, your calendar and your customer records is one wrong edit away from failing quietly, and quietly is the expensive way for it to fail. Keeping the edits in one pair of hands is how it keeps working.

So ongoing management comes with every automation we build, rather than being something added to it. An automation is priced in two parts: a build cost, which is the work of designing and personalising it to your business, and ongoing management, which is the work of running it. The build is paid once. The management is what keeps it alive.

07If you stop an automation

Stop the management and the automation stops. There is no softer way to put it and we would rather you read it here than discover it later: you are not left holding something you can run yourself.

What you keep is the personalisation. The version of the process built around how your business actually works is yours, and it stays yours whether or not it is running. Come back to us later for the same automation and you do not pay to build it a second time. You pick up where you left off and start the management again.

The one thing it is not is portable. You cannot hand the running configuration to another provider, because it is not a file sitting in an account of yours: it is a configuration on a platform we operate. You own the process and the design of it. You do not get to take our implementation of it elsewhere.

If that is a problem for how you want to buy, say so before we start. We would rather talk you out of an automation at the beginning than have you find out at the end that it was not the thing you thought you were buying.

08Ongoing management, and ending it

Where we manage a site or run automations for you, it is a continuing arrangement at an agreed fee. Either of us can end it. You do not owe us a reason, and we would ask the same courtesy.

When management of a website ends, the site is yours and keeps running. When management of an automation ends, the section above applies.

09What we need from you

A project depends on content, access and decisions coming back to us. You are responsible for the accuracy of what you give us and for having the right to use it, including any text, images, logos or customer lists you hand over. If something you supply infringes someone else’s rights, that is not something we can carry for you.

10Our own content

The design, text, artwork and code of this website are ours. Please do not reproduce substantial parts of it for your own commercial use. Linking to it, quoting it with attribution, and sharing it are all fine.

11Showing work publicly

We will not put a client’s name, logo or screenshots on this site or anywhere else without asking them first. If you would rather we did not mention working with you at all, say so and that is the end of it.

12Third-party services

This site uses Web3Forms to deliver contact form messages, and links out to Google Calendar for bookings. Their availability and their terms are their own. Links to other websites are not endorsements, and we are not responsible for their content.

Automations we build for a client depend on third-party services, which can include AI providers, to do their work. We will tell you which services a given automation uses and what passes through them. Where one of those services has an outage or changes how it works, the automation is affected too, and that is outside anything we can guarantee.

13Liability

Nothing in these terms limits any rights you have under the Australian Consumer Law, which cannot be excluded. Subject to that, we are not liable for indirect or consequential loss arising from use of this website, and our liability in connection with a project is governed by the agreement for that project.

14Governing law

These terms are governed by the laws of Western Australia, and the courts of Western Australia have jurisdiction.

15Changes

We may update these terms. The version published here is the one that applies, and the date at the top shows when it last changed.
